CHAPTER 4
PART I: The state and SovereignityArticle One
- The united republic of Cameroon shall with effect from the date of entry into force of this law be known as republic of Cameroon.
- The republic of Cameroon shall be decentralized unitary state. It shall one and indivisible, secular, democrate, dedicated to social senire. It shall recognize and protect traditional service. It shall recognize and protect traditional values that conform to democratic protect traditional values that conform to democratic principles, human rights and the law. It shall ensure the equality of all citizens before the law.
- The official languages of the republic of Cameroon shall be English and French both languages having the same status, the state shall guarantee the promotion of bilingualism through the country. It shall endeavor to protect and promote and promote national language.
- It motto shall be peace-work-fatherland.
- Its flag shall be three equal vertical stripes of green, red and yellow charged with one gold star the center of the red stripe.
- Its national anthem shall be “O Cameroon crodle of our father”
- The capital of the republic of Cameroon shall be Yaounde.
ARTICLE 2
- National sovereignty shall be wested in the people of Cameroon shall exercise some either through the president of the republic and members of parliament or by way of referendum. No section of the people or individual shall arcogatte to itself or himself the exersice there of.
- The authorities responsible for the management of the State shall derieve their powers from the people through election by direct or indirect universal suffrage unless otherwise provided for in this constitution.
- The vote shall be equall and secret and every citizen aged 20 years and above shall beentiled to vote.
ARTICLE 3
Political parties and groups shall hold the election in the making of voting decisions. They shall be bounder respect the principles of democracy, national souveregnity and unity. The shall be formed and shall exercise their activities in accordance with the law.
ARTICLE 4
State power shall be exercised by the president of the republic and parliament.
EXECUTIVE POWERS
The president of the republic.
ARTICLE 5
- The president of the republic shall be head of the state.
- Elected by the whole nation shall be the symbol of national unity.
- He shall ensure respect for the constitution
- He shall through his arbitration, ensure the proper functioning of public authorities.
ARTICLE 6
- The president of the republic shall be elected by the majority of the vote cast(population) through equal and secret universal suffrage/
- (new) President of the republic shall be elected for a term of 7yrs. He shall be eligible for reelection.
- The election shall be held not less than 29yrs and not more than 50 days before the expicing of the term of the republic in office
- (New)Where the office of president of the republic becomes vacant as a result of death, registration or permanent incapacity duly ascertained by the election of the new president of the republic must be held not lessthan 20 days and not more than 120 days after the becomes vacant.
- The president of the senate shall as of right act as interian president of the republic is elected. Where the president of the senate is unable to exercise his power they shall be execised by his voice following te order

- However where the organization of the presidential elections requires, the interim president of the republic may after consultation with the constitutional council among the composition of the government.
- Candidate for the office of president of the republic must be Cameroonian by birth, enjoy their cuivre and political right and must have attained the age of 35.
- The conditions for electing the president of the republic shall be loud down by law.
ARTICLE 7
- The president elect shall assure office once he has been sworn in
- The wording of the oath and the procedure for implementing the provisions of paragraph 1 and 2 above shall be laud down by law
- The office of the republic shall be incorpatible with any other elective public office professional activities
ARTICLE 8
- The president of the republic shall represent the state in all acts of public life.
- He shall be head of the armed forces
- The shall ensure the internal and external security of the republic.
- The president of the republic shall enact law as prouved foreign article foreign Article 31 below.
- He shall exercise statutry authority.
- He shall appoint to civil court and honorary distinction of the republic.
ARTICLE 9
- The president of the republic may where circumstances so warrant, declare by a state of emergency which shall confer upon him such special powers as may by provided for by law.
- In the event of a serious threat to the nation’s territorial integrity or to its existence, its independence or institutions, the president of the republic may declare a state of stage by decree and take any measure as he may deem necessary he shall inform the nation of his decision by message.
ARTICLE 10
- The president of the republic shall appoint the prime minister and on the proposal of the latter the other members of government.
- He shall define their duties
- He shall terminates their appointment
- He shall preside over the council of Ministers
- The president of the republic may delegate some of his powers to the prime minister, other members of government and any other senior administrative officials of the state, within the form work of their respective duties.
- Where the president of the republic is temporarily unable to perform his duties, he shall delegate the prime minister and should the latter also be unavailable any other member of government to discharge his duties within the framework of an express delegation of some of his powers.
THE GOVERNMENT
ARTICLE 11
The government shall implement the policy of the nation as defined by the president of the republic.
It shall be responsible to the national Assembly under the condition and procedures provided for in article 34 below.
ARTICLE 12
- The prime minister shall be the head of government and shall directs its action.
- He shall be responsible for the enforcement of the law
- He shall exercise statutory authority and appoint to civi posts, subject to the prerogatives of the president of the republic in such areas.
- He shall direct all the government services required for the accomplishment of his duties.
- He may delegate some of his power to members of government and to senior state officials.
ARTICLE 13
The office of members of government and any official ranking as such shall be imcompatible with that of members of parliament, chairman of the executive Or Assembly of a local or regional authority leader of a national professional association, or with any other employment or professional activity.
